DMCA Policy

Resync ("the Platform") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond promptly to claims of copyright infringement reported to our designated copyright agent.

1. Reporting Copyright Infringement

If you believe that content available on or through the Platform infringes your copyright, please submit a notification containing the following information to our designated DMCA agent:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
  • Identification of the copyrighted work claimed to have been infringed
  • Identification of the material that is claimed to be infringing, and information reasonably sufficient to permit us to locate it on the Platform
  • Your contact information, including your name, address, telephone number, and email address
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner

2. DMCA Agent Contact Information

Please note that only DMCA notices should be sent to the designated agent. Any other inquiries should be directed to our general support channels.

3. Processing of Takedown Notices

Upon receipt of a valid DMCA takedown notice, we will:

  • Remove or disable access to the allegedly infringing material promptly
  • Notify the content provider, seller, or user that the material has been removed or disabled
  • Provide the content provider with a copy of the takedown notice so they may submit a counter-notification if applicable

4. Counter-Notification

If you believe that material you posted was removed or access was disabled by mistake or misidentification, you may file a counter-notification. A valid counter-notification must include:

  • Your physical or electronic signature
  • Identification of the material that has been removed and the location at which it appeared before removal
  • A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification
  • Your name, address, and telephone number, along with consent to the jurisdiction of the federal court in your district

Upon receiving a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10 business days, we may restore the removed material.

5. Repeat Infringers

It is our policy to terminate, in appropriate circumstances, the accounts of users who are repeat infringers. If a user is found to have repeatedly uploaded, sold, or distributed copyrighted material without authorization, their account will be permanently suspended and all associated product listings will be removed.

6. Good Faith Requirement

PLEASE BE AWARE THAT UNDER SECTION 512(f) OF THE DMCA, ANY PERSON WHO KNOWINGLY MATERIALLY MISREPRESENTS THAT MATERIAL IS INFRINGING MAY BE SUBJECT TO LIABILITY FOR DAMAGES.

Before filing a DMCA notice, please ensure that the material in question actually infringes your copyright. If you are unsure, we recommend consulting with a legal professional before submitting a takedown request.

7. Modifications to This Policy

We reserve the right to modify this DMCA Policy at any time. Changes will be effective immediately upon posting to the Platform. Your continued use of the Platform following any changes constitutes your acceptance of the revised policy.
